Legal Disclaimer for Oath, Inc.
Oath, Inc. (“Oath”) acts solely as an intermediary to connect individuals seeking adventure experiences (“Participants”) with third-party companies that provide such activities (“Adventure Providers”). By using our services, Participants acknowledge and agree to the following terms and conditions:
- Age Requirement: By using Oath’s services and participating in any adventure activities, Participants affirm that they are at least 18 years old. Oath’s services are not intended for individuals under the age of 18, and no one under this age is permitted to participate in activities arranged through Oath.
- Personal Responsibility: Participants acknowledge that they are fully responsible for their actions and decisions. Participants agree to exercise due diligence, caution, and judgment when engaging in adventure activities.
- No Liability for Third-Party Actions: Oath does not own, operate, or manage any of the adventure activities or services offered by the Adventure Providers. Consequently, Oath is not responsible for the actions, omissions, or negligence of any Adventure Providers, their employees, agents, or contractors.
- Assumption of Risk: Participants acknowledge that adventure activities, including but not limited to outdoor sports, extreme activities, and travel excursions, inherently involve risks, including the risk of injury, death, or property damage. Participants voluntarily assume all risks associated with these activities.
- Release of Liability: Participants agree to release, waive, and discharge Oath, its officers, directors, employees, and agents from any and all liability, claims, demands, or causes of action that may arise out of or relate to participation in any activities arranged through Oath. This release applies to all claims for personal injury, wrongful death, property damage, and any other type of loss or damage.
- Indemnification: Participants agree to indemnify, defend, and hold harmless Oath from and against any and all claims, liabilities, damages, costs, and expenses (including attorneys’ fees) arising out of or related to their participation in any adventure activities, including but not limited to claims brought by third parties.
- Purchaser’s Responsibility: If a Participant purchases Oath’s services on behalf of another person, the Purchaser represents and warrants that they have the legal authority to waive the rights of the Participant on their behalf. By making such a purchase, the Purchaser agrees to all terms and conditions of this legal disclaimer on behalf of the Participant.
- Compliance with Instructions: Participants agree to obey and comply with all instructions and guidelines provided by the Adventure Providers. Failure to comply with these instructions may result in serious injury or death.
- Disclosure of Medical Conditions: Participants agree to disclose any medical conditions, disabilities, or other health-related issues that may preclude them or the people they are signing up for the adventures from participating safely. Participants acknowledge that failing to disclose such information may put the lives of other participants, bystanders, operators, and the general public at risk.
- No Warranty: Oath makes no warranties or representations, express or implied, regarding the quality, safety, or suitability of the adventure activities provided by the Adventure Providers. Participants are responsible for independently evaluating and selecting the Adventure Providers and activities that best suit their needs and capabilities.
- Medical and Insurance Coverage: Participants are solely responsible for obtaining adequate medical insurance coverage and any other necessary insurance to cover risks associated with adventure activities. Oath does not provide any insurance coverage for Participants.
- Compliance with Laws: Participants are responsible for complying with all local, state, and federal laws and regulations applicable to the adventure activities they participate in.
- Severability: If any provision of this legal disclaimer is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. By using Oath’s services, Participants acknowledge that they have read, understood, and agreed to the terms of this legal disclaimer. If Participants do not agree to these terms, they should not participate in any activities arranged through Oath.
